Terms of Service

These terms govern use of the TextCatch service, operated by Apex AI Systems ("TextCatch," "we," "us"). By signing up as a business client you agree to them. If you also signed a separate Service Agreement with us, that agreement controls wherever the two differ. Want a copy of the Service Agreement before you buy? The service
TextCatch automatically texts back callers who reach your business line when a call goes unanswered, engages them in a qualifying conversation, and helps schedule or escalate as configured on your account.
Pricing
$2,500 activation fee, charged in full at signing, plus $297 per month starting once your number is live. There are no usage charges, no per-message fees, no overage charges and no add-on fees — $297 is the whole monthly cost regardless of how many calls or messages your account handles.
Automatic renewal — please read
Your subscription renews automatically. By providing a payment method you authorize us to charge it $297 every month, automatically, on the same day of each month, until you cancel. There is no fixed end date and no minimum term — the charge simply continues each month until you stop it. We'll tell you your next charge date on the Billing page in your account at all times.
Your price won't change without us telling you in advance. If we ever change the monthly amount, we'll notify you at least 30 days before the first changed charge, and you can cancel before it takes effect.
How to cancel
You can cancel yourself, at any time, from inside your account: Settings → Cancel subscription → confirm. That's the whole process. You do not have to call us, email us, sit through a retention offer, or get anyone's approval. There is no cancellation fee.
Cancellation takes effect immediately. As soon as you confirm, future billing stops and missed-call texting stops with it — including any follow-up texts already queued for conversations you had running, which are cancelled rather than left to finish sending. The same applies if an account is suspended. The month you have already paid for is not prorated or refunded, so if you want the rest of the month you've paid for, cancel near the end of your billing month rather than at the start of one. Your account and conversation history are kept, so you can restart later by contacting us.
If you'd rather cancel by writing to a person instead, open a support ticket from inside your account and we'll process it for you. The in-app button is faster and always available.
The First Save Guarantee
If TextCatch doesn't recover at least one job's worth of revenue for your business in your first 30 days live, your activation fee is refunded in full. The full terms of that guarantee:
- What's refunded: the $2,500 activation fee only. Monthly fees for service already delivered are not refunded.
- When the 30 days run: from the day your number goes live, not the day you sign.
- How to claim: ask us in writing — a support ticket in your account — within 15 days after that 30-day window ends. We'll confirm the recovered jobs with you directly, using your own conversation history — no automated score decides it.
- Payout: approved refunds are returned to your original payment method within 7 business days of approval. Refunds are reviewed and issued by a person and are not automatic or instant.
- Outside the guarantee: the activation fee is otherwise non-refundable.
AI-generated responses
Responses to your callers are generated by an AI system configured with your business information. While designed to be accurate, AI responses may occasionally contain errors. Emergency-related messages (gas smell, no heat, fire, and similar) are normally flagged by the AI; a separate, fixed safety message — never AI-generated — is always what actually goes out to the caller, directing them to call 911, with you alerted immediately. If the AI answers with something the system can't read, that message is treated as a possible emergency outright, no further check applied. If the AI can't be reached at all — an outage, a timeout, repeated errors — detection falls back to a fixed keyword check run on the caller's own message instead of the AI, rather than skipping detection. Either way, the system defaults to treating an uncertain case as a possible emergency rather than assuming it isn't one, though the keyword fallback is necessarily cruder than the AI's own judgment. This feature supports your own emergency response process; it doesn't replace it.
Your responsibility for compliance
Every text the service sends to your callers on your behalf goes out from a number assigned to your business, under your business name, about your services. (Our own sales outreach to businesses we'd like as clients is the one thing that doesn't — that goes out from TextCatch's own number, on our own account, and never touches your callers or your number.) For the Telephone Consumer Protection Act (TCPA) and the equivalent state laws, you are the sender of record and TextCatch is the technology that transmits on your instruction. We don't choose who gets messaged — your callers do, by calling you and not reaching an answer.
What TextCatch does for you. These are working mechanisms in the product, not intentions:
- Opt-out. A reply beginning with STOP, UNSUBSCRIBE, QUIT, CANCEL, END, REVOKE, STOPALL or OPTOUT — plus natural phrasings like "please stop" and "stop texting me" — suppresses that number immediately, cancels every scheduled follow-up queued for them, and sends one confirmation.
- Plain-language opt-out. A caller who asks to stop being contacted without using a keyword — "take me off your list", "remove me", "do not contact me" — is treated as having opted out, with the same suppression, the same cancellation of queued follow-ups and the same confirmation. The assistant makes that call, because it is the only reader that can tell such a request apart from an ordinary message about the job ("can I cancel my appointment?"). It covers clear requests to stop contact; the keywords above remain the guaranteed path.
- HELP returns your business name, opt-out instructions, a link callers can use to reach us, and a message-and-data-rates disclosure. START opts someone back in.
- Suppression is enforced on every send path — the automated reply, the scheduled follow-ups, messages you type yourself, and booking or payment links.
- Quiet hours on the first reply, follow-ups, and manual sends. The automated first reply to a missed call, scheduled follow-ups, and anything you type and send yourself are all held to 8:00am–8:00pm in the time zone of the caller's area code, and to Texas's stricter 9:00am–9:00pm (noon–8:00pm Sunday) window for Texas numbers. A message that would land in a quiet period is deferred to the next permitted hour, not dropped — except a manual send, where you're asked to confirm before it sends anyway. One thing this doesn't cover: once a caller has texted in and a live conversation is underway, the AI's replies within that same back-and-forth go out right away, whatever the hour, since it's responding to something the caller just sent rather than starting new contact.
What stays with you. TextCatch is not a system of record for consent and does not scrub Do-Not-Call registries. You are responsible for: not using the product to message anyone who hasn't first contacted your business; the content of any template you edit or message you write yourself; holding prior express written consent if you turn a reply into marketing; choosing to override the quiet-hours prompt on a message you send by hand; and the stricter texting laws several states apply to their own residents — Florida, Oklahoma, Washington and Maryland among them, with per-message statutory damages and private rights of action. Consult your own counsel on consent requirements specific to your business and the states you operate in.

A2P 10DLC registration
US carriers block business text messages sent from unregistered 10-digit numbers outright. Your TextCatch number is a dedicated local 10-digit number, so registration isn't optional — an unregistered number doesn't send degraded traffic, it sends none.
TextCatch registers and maintains the A2P 10DLC brand and campaign for your number, and covers the carrier registration and per-message fees inside your $297. You supply accurate business details for that registration — legal business name, EIN, address, website, an authorized contact — and tell us when they change. A registration rejected for inaccurate information delays your number going live, and we won't tell you your number is live for messaging before it's approved. If carriers later suspend your campaign for reasons specific to your content or business, we'll help you remediate but can't guarantee reinstatement.
Acceptable use
You agree not to use TextCatch to send unsolicited marketing, to contact people who haven't contacted your business, to send unlawful, deceptive or harassing content, or to configure the service with business information you know to be false. You're responsible for the business information you give us, which is what your callers' replies are generated from.
Specifically prohibited, and grounds for immediate suspension without refund: uploading, importing or hand-entering numbers from a purchased, rented or scraped lead list in order to message them; using the in-app manual message feature to start a conversation with someone who never contacted you; and content the CTIA Messaging Principles prohibit on carrier networks — sex, hate, alcohol, firearms and tobacco content, cannabis, and loan or debt-relief offers. These aren't house rules; they are the conditions under which carriers carry your traffic at all.
No warranty
TextCatch is provided "as is." We don't warrant that the service will be uninterrupted or error-free, that every message will be delivered (carrier delivery is outside our control), or that using it will produce any particular number of jobs, leads or revenue. Nothing on our website or in our sales materials is a promise of a specific business result. Where your state doesn't allow a warranty to be disclaimed, this section applies to the maximum extent it does allow.
Limitation of liability
TextCatch's total liability under these terms is limited to fees paid in the preceding 3 months. Neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or lost business. These limits don't apply where a limitation isn't permitted by law, or to our own gross negligence or willful misconduct.
Indemnity — both directions
You'll defend and indemnify us against third-party claims arising from your use of the service in breach of the "Acceptable use" or "Your responsibility for compliance" sections above — including TCPA and state-law messaging claims brought over how you chose to use the service, over content you wrote or edited, over a consent you didn't have, or over registration details you gave us that weren't accurate. We'll tell you promptly about any such claim and let you control the defense.
We indemnify you the other way for the failure that's ours. If someone validly opted out through the service and our system sent them another automated message anyway, that's our suppression failing, not your decision — and we'll defend and indemnify you for a claim to that extent. The liability cap above doesn't limit either side's indemnity.
Suspension and termination by us
We may suspend or terminate your account if payment fails and stays unpaid, if you breach the "Acceptable use" section, or if we're required to by law or by our carrier or messaging providers. Except for an emergency or a legal requirement, we'll give you notice and a reasonable chance to fix the problem first. If we terminate without cause, we'll refund the unused portion of any month you've already paid for.
Changes to these terms
We may update these terms. For any change that materially affects your rights, your price, or your renewal or cancellation terms, we'll give you at least 30 days' notice before it applies to you, and you can cancel before it takes effect. Other changes take effect when posted, and we'll update the "Last updated" date above.
How we give you notice
Wherever these terms say we'll notify you — a price change, a terms change, or a suspension warning — that notice goes out through an in-app notification in your account and/or the email address on your account, whichever reaches you. Keep a working email on file and check in-app notifications regularly; notice is effective when we send it, not when you read it.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. If any part of these terms is found unenforceable, the rest stays in effect.
Contact
Questions about these terms, cancellations, or a First Save Guarantee claim: if you have account access, open a support ticket from inside it — that reaches us fastest and in writing. If you don't have an account yet, or you can't log in for any reason, book a call with us instead — that channel works whether or not your account is active, so it's always available even if we've closed your account. You never have to book a call to cancel a working account — that's always available directly in Settings.
